According to the Decree No. 152/2020/ND-CP detailing the implementation of a number of articles of the Labor Code regarding foreign workers in Vietnam, foreign experts are those who are one of the following cases:
- Having a bachelor’s degree or higher or equivalent and having at least 03 years of working experience in a specialized major relevant to the position in which the foreign worker is expected to work in Vietnam;
- Having at least 05 years of experience and having a practising certificate relevant to the position.
Some common expert positions are:
+ Sales experts;
+ Technical experts, engineers;
+ Marketing experts;
+ Managers, group leaders, ministers;
+ Language teachers: English, Japanese, Korean…; teachers of Yoga, Gym;
+ Chefs, culinary experts, etc.
Procedures for applying for Vietnam work permit for foreign experts
To apply for work permit for foreign experts, you need to follow the following steps:
Step 1: Submitting an application for approval letter for employment of foreign workers at the agency competent to grant work permits. The competent labor management agency shall handle the procedures within 10 working days from the date of receipt of a complete and valid application.
Step 2: Preparing an application for work permit to submit to the agency competent to grant work permits.
Requirements for documents to apply for work permit for experts:
+ Copy of valid passport or international travel document.
+ 02 4x6 photos, white background.
+ Application form for work permit under form No. 7.
+ Certificate of health examination issued by a competent foreign or Vietnamese medical agency or organization.
+ Certificate of criminal record or a document certifying that the foreign expert has not committed a crime or is being prosecuted for penal liability, issued by a foreign country.
+ Documents and papers proving that they are experts: Bachelor’s degree or higher or equivalent; Certificate of working experience of 3 years or more at foreign agencies and enterprises; Certificate of experts issued by agencies/enterprises in foreign countries.
+ Some other relevant documents: Employment contract, Appointment decision, etc.
Step 3: Submitting application and receiving results.
+ If the enterprise is located in an industrial zone, the application shall be submitted to the Management Board of industrial zones of the province or city.
+ If the enterprise is located outside the industrial zone, the application shall be submitted to the Department of Labor - Invalids and Social Affairs of the province or city.
If the application for work permit for experts is valid, the results will be obtained within 5-7 working days.
Notes when applying for Vietnam work permit for foreign experts
+ Submitting 1 original and 1 copy of the required documents in the application.
+ All documents and papers must be legalized by consular agency.
+ Consular legalization is exempted if those papers are written in a foreign language, but they must be translated into Vietnamese and certified in accordance with Vietnamese law.
+ Certificate of criminal record, health examination certificate or equivalent papers must be valid for at least 06 months.
