Processing time for granting work permits is only 5 working days

The processing time for granting Vietnam work permits is only 05 working days, the Department of Labour - Invalids and Social Affairs will return the results to the applicants while previously, the time was 07 days.

Clause 2, Article 11 of the Decree No. 152/2020/ND-CP stipulating foreigners working in Vietnam clearly specifies:

 “Within 05 working days from the date of receipt of a complete application for work permit, the Ministry of Labour – Invalids and Social Affairs or the Department of Labour - Invalids and Social Affairs of place where the worker is expected to work shall grant a work permit to the foreign worker according to Form No. 12/PLI Appendix I issued together with this Decree. The work permit form is printed and issued uniformly by the Ministry of Labour – Invalids and Social Affairs. In case of refusal to grant a work permit, it is required to have a written reply clearly stating the reason.”

The Decree No. 152/2020/ND-CP takes effect from February 15, 2021.

Meanwhile, Clause 2, Article 12 of the Decree No. 11/2016/ND-CP detailing the implementation of a number of articles of the Labor Code about foreign workers in Vietnam clearly specifies:

 “Within 07 working days from the date of receipt of a complete application for work permit, the Department of Labour - Invalids and Social Affairs shall grant a work permit to the foreign worker according to the form provided by the Ministry of Labour – Invalids and Social Affairs. In case of refusal to grant a work permit, it is required to have a written reply clearly stating the reason.”

Thus, from February 15, 2021, the processing time for granting work permits will be shortened to only 05 days.
