In September, the Ministry of Labor, Invalids and Social Affairs loosened some regulations on work permits for foreigners working in Vietnam. This helps businesses and foreigners reduce difficulties in the process of completing procedures to adapt to the new context like today.
The Government’s Resolution No. 105/NQ-CP on supporting enterprises, cooperatives and business households in the context of Covid-19 epidemic has just been promulgated and it stipulates to create favorable conditions for workers and experts.
Accordingly, in September, the Ministry of Labor, Invalids and Social Affairs directed local authorities to flexibly implement and loosen a number of regulations and conditions on the grant, extension and certification of work permits for foreign workers in Vietnam to adapt to the new context and ensure the safety in COVID-19 prevention and control.
Specifically, the provisions at Point a, Clause 3, Article 3 of Decree No. 152/2020/ND-CP are as follows: Having a bachelor’s degree or higher or equivalent and having at least 3 years of work experience relevant to the position that the foreign worker is expected to work in Vietnam.
The provisions of Point a, Clause 6, Article 3 of Decree No. 152/2020/ND-CP are as follows: Having been trained in a technical or other major for at least 01 year and having at least 03 years of work experience relevant to the position that the foreign worker is expected to work in Vietnam.
The provisions at Point b, Clause 4, Article 9 of Decree No. 152/2020/ND-CP are as follows: Papers proving that experts and technical workers as prescribed in Clauses 3, 6, Article 3 of this Decree include: Qualifications, diplomas, certificates; written certification from an agency, organization or enterprise in a foreign country to certify the number of years of work experience of the expert, technical worker or the granted work permit to prove the experience.
The provisions at Point d, Clause 3 of Article 8, Clause 7 of Article 9, Clause 5 of Article 17 of Decree No. 152/2020/ND-CP are as follows: Copy of the valid passport as prescribed by law.
Foreign workers who have been granted a valid work permit are permitted to be sent, dispatched or seconded to work in another province or city for a period not more than 06 months and the employer must report to the labor management agency where the foreign workers come to work and do not need to renew the work permit.
According to the Ministry of Labor, Invalids and Social Affairs, as of the beginning of April, there were 101,550 foreign workers in Vietnam, of which the percentage of managerial positions accounted for nearly 12%, executive directors accounted for more than 8 % and most of them are experts, accounting for 58%, etc.
Foreign workers in Vietnam come from 110 countries and territories, most of which are from China, Korea, Japan, etc.
