The latest conditions and procedures for renewal of a work permit

From February 15, 2021, the renewal of a work permit for foreigners can only be done once for a maximum period of 2 years. In addition, the Decree 152/2020/ND-CP also clearly states the conditions, documents and procedures for foreign workers’ work permits renewal.

Conditions for the renewal of work permits

  • The issued work permit has the validity for at least 05 days, but not more than 45 days.
  • The demand for foreign workers is approved by the competent authority.
  • Documents proving that the foreign worker will continue working for the employer according to the contents of the issued work permit.

Application documents for renewal of work permits

  • A written request for renewal of work permits of the employer using Form No. 110/PLI.
  • 02 color photos (4cm x 6cm, on white background, straight face, bare head, no colored glasses), taken within 06 months from the date of application.
  • Valid issued work permit.
  • Written approval for the demand of using foreign workers, except for such cases where the need to use foreign workers is not determined.
  • A certified copy of the passport, which still is valid as prescribed by the law.
  • Medical certificate or health certificate as prescribed by the law.
  • Documents proving that the foreign worker will continue working for the employer according to the contents of the issued work permit.

Note: Original documents or certified copies, if being issued in foreign countries, must be consular legalized and translated into Vietnamese unless they are exempt from consular legalization as prescribed.

Procedures for renewal of work permits

Enterprises and organizations guaranteeing the employment for foreigners must carry out the following procedures for renewing work permits.

Step 1. At least 05 days but no more than 45 days prior to the expiration date of the work permit, the employer must submit a request for renewal of the work permit to the Ministry of Labor, Invalids and Social Affairs or the Department of Labor, Invalids and Social Affairs issuing the same.

Step 2. Within 05 working days from the date of receipt of a complete application for the renewal of a work permit, the relevant competent authority shall renew the same. If the renewal request is refused, a written reply clearly stating the reason will be granted.

Step 3. For the foreign worker working under the labor contract, after his/her work permit being renewed, the employer and the foreign worker must enter into an a written labor contract in accordance with Vietnam's labor law before the expected date of continue working for the employer.

The employer must send the signed labor contract upon request to the competent authority renewing such work permit. Such submitted Labor contract shall be an original or an certified copy.
