In addition to the normal cases of granting, re-granting of Vienam work permits or confirmation of work permit exemption, there are special cases in the process of recruitment and employment of foreign workers. Clause 9, Article 9 of the Decree No. 152/2020/ND-CP (effective from February 15, 2021) specifies as follows:
Case: Foreign workers who have been granted work permits which are still valid and wish to work for another employer in the same job position and the same job title stated in the work permit.
An application for a new work permit shall include:
+ The employer’s written request for work permit in accordance with regulations of the Ministry of Labour - Invalids and Social Affairs (form No. 11/PLI).
+ Certified copy of passport which is still valid according to regulations of laws.
+ 02 colored photos, size: 4cm x 6cm.
+ Written approval for the demand of employing foreign worker (except for cases where the need to employ foreign worker is not required).
+ Granted work permit.
+ The current employer’s confirmation to certify that the worker is currently working.
+ Documents related to the foreign worker (depending on each specific case - contact Nhi Gia for instructions).
Case: Foreign workers who have been granted work permits which are still valid and wish to change to other job position or job title or form of employment which is different from the one stated in the work permit according to regulations of laws but not change the employer.
An application for a new work permit shall include:
+ The employer’s written request for work permit in accordance with regulations of the Ministry of Labour - Invalids and Social Affairs (form No. 11/PLI).
+ Documents and papers proving that the foreign worker is a manager, executive director, expert, technical worker and some occupations and jobs (depending on each specific case - contact Nhi Gia for instructions).
+ 02 colored photos, size: 4cm x 6cm.
+ Written approval for the demand of employing foreign worker (except for cases where the need to employ foreign worker is not required).
+ Certified copy of passport which is still valid according to regulations of laws.
+ Documents related to the foreign worker (depending on each specific case - contact Nhi Gia for instructions).
+ Granted work permit.
